Lucy McLernon of O’Reilly Stewart Solicitors acted on behalf of a Plaintiff who suffered a devastating stillbirth of her baby in 2015.
It was alleged that due to a failure to properly monitor the baby’s growth, the Hospital failed to appreciate that the baby was small for their gestational age. Had this been properly appreciated and managed, the Plaintiff should have been referred for earlier delivery of her baby.
As a result of the tragic loss, the Plaintiff suffered a psychiatric injury and upset. Independent expert evidence was obtained from obstetric, psychiatric and psychology experts in support of our client’s case.
Liability was admitted by the Hospital Trust and the matter was settled during the course of proceedings, by way of a negotiated settlement in June 2024, after O’Reilly Stewart had taken over conduct of the proceedings in 2022. Our client received damages in the sum of £200,000 to compensate her in relation to the injury and loss suffered. Our client also recovered her full costs arising from the investigation of the case.
