The Plaintiff was admitted to Antrim Area Hospital in August 2020 with symptoms of appendicitis. She was advised that she would require surgery to remove the appendix, which was performed the following day. Post-operatively, the Plaintiff was advised that all had gone to plan, and that her appendix had been removed. Her condition failed to improve however, and instead she deteriorated.
Seven days following the initial surgery, a CT scan was performed which indicated that the appendix had in fact, not been removed. The Plaintiff was told that her symptoms would have to be managed conservatively for a period of time pending further surgery to remove the appendix. She ultimately underwent a further surgery in April 2021.
Aine Tyrrell of O’Reilly Stewart Solicitors was instructed on behalf of the Plaintiff and proceedings were issued on her behalf in July 2023. The claim was based on the fact that there was a failure on the part of the Defendants to remove the Plaintiff’s appendix during the original procedure, to then recognise the fact that her appendix had not been removed, thus resulting in the need for a second unnecessary procedure some months later. Our client also experienced significant levels of pain, suffering and psychological upset as a result of these events. An admission Defence was received from the Defendants in February 2025 and the matter was ultimately settled by way of negotiations in February 2026.
