O’Reilly Stewart Solicitors recently obtained a settlement of £35,000.00 on behalf of the estate of our client who suffered significant injuries due to negligent treatment in relation to the management of his Parkinsons Disease. The settlement was made without admission of liability. Claire Hunt dealt with the matter.
Our client was first diagnosed with Parkinsons Disease in 2010 and was prescribed medication for the same by a Consultant Neurologist. Over time, the dosage of this medication was increased such that it was in excess of the recommended maximum dosage. Our client began to experience significant side-effects including weight gain, constipation, somnolence and hallucinations. In addition, he developed Impulsive Compulsive Disorders characterised by over-eating and excessive spending.
Our client and his family therefore instructed us to investigate the standard of treatment which he had received. As such, we obtained copies of our client’s clinical records and instructed an independent Consultant Neurologist and an independent Consultant Physician. It was our experts’ opinion that the treatment which had been provided to our client fell below the standard to be expected of a reasonably competent Consultant Neurologist. For example, it was noted that there was a failure to discuss the potential side-effects from the prescribed dopaminergic and dopa-agonist drugs or the risk of developing Impulsive Compulsive Disorders. Furthermore, there was a failure to regularly review our client’s condition and to refer him to the care of a specialist nurse.
Sadly our client passed away whilst his case was ongoing and his family therefore continued to pursue his case on behalf of his estate. Whilst it was necessary to issue High Court proceedings, damages of £35,000 plus payment of the reasonable legal costs were ultimately agreed.
