O’Reilly Stewart have acted in a complex TUPE matter in which the employer made its employee redundant. The employee believed that his role continued to be carried on by another individual post the transfer. In making him redundant, the employer had failed to comply with its obligation to inform and consult under the Transfer of Undertakings (Protection of Employment) Regulations 2006.
