O’Reilly Stewart Solicitors recovered £150,000 on behalf of a victim of medical negligence. The patient began to experience symptoms associated with a heart attack during the course of the early evening at home. She contacted the Emergency Services and an Ambulance was sent to her home. The patient was assessed by a Paramedic who wrongly advised the patient that she was suffering from pain and discomfort associated with a gastric complaint. That is notwithstanding the fact that during the course of the attendance an examination was carried out, using an ECG, which demonstrated abnormal findings.
Due to the failure on the part of the Paramedic to correctly identify that the patient had suffered a heart attack, there was a three hour delay in her admission for appropriate care. The patient suffered extreme pain and discomfort whilst waiting for an appropriate diagnosis and treatment. As a consequence of that delay, the patient suffered further damage to her heart which would have been avoided had timely care been provided.
The patient now suffers from shortness of breath and fatigue which are attributable to the delay in diagnosis and treatment. Furthermore the patient’s life expectancy has been adversely affected by reason of the said delay. The patient became anxious and suffered post traumatic stress disorder due to her experience.
By reason of the limitations imposed upon the patient by her medical condition, she has required care and assistance on an ongoing basis, and will continue to require care in the future.
Mr Patrick Mullarkey was instructed by the patient and her family in July 2016. Legal proceedings were issued in March 2018, and the case was listed for hearing in December 2019. The case was resolved, by way of negotiated settlement between the parties, in October 2019.
