Accidents in the Air

Kevin Hegarty was instructed by a client who sustained an injury when travelling on an aeroplane operated by a major global airline. During the course of the flight, our client suffered injury when a member of the flight team inadvertently caused a hot drink to spill on our client’s lap. This caused burns to our client’s leg which required hospital treatment. Once instructed, Kevin argued that the incident fell within the terms of the Montreal Convention which governs accidents mid-flight, and consequently we were entitled to pursue the matter in the Republic of Ireland as this was the ultimate flight destination. We obtained appropriate medical evidence from a Consultant Dermatologist and ultimately, after negotiations with solicitors for the major airline, the matter was settled pre-proceedings for £11,000.
