The Employment Team at O’Reilly Stewart Solicitors successfully represented a client in an unfair constructive dismissal claim before the Industrial Tribunal of Northern Ireland, brought against a packaging manufacturer.
Over a four-day hearing, the Tribunal heard evidence from both the Claimant and Respondent, as well as their respective witnesses. The Claimant argued that she had been dismissed and that the dismissal was unfair. The Respondent disputed that any dismissal had occurred. Alternatively, they claimed that if there was a dismissal, any compensation should be reduced by 100% due to alleged contributory conduct and a failure to mitigate loss.
The Tribunal found unanimously in favour of our client, concluding that she had indeed been dismissed and that the dismissal was unfair. No potentially fair reason for dismissal was put forward by the Respondent, and the Tribunal determined that the Claimant was not guilty of any blameworthy conduct contributing to the dismissal.
As a result, the Claimant was awarded £87,000, based on an agreed Schedule of Loss.
