£40,000 Damages for Employee’s Workplace Hand Injury

O’Reilly Stewart Solicitors were instructed to investigate injuries sustained by our client, Mr D, following an accident at work in November 2023. Dionne Darragh acted in this case.

On the dated of the incident, our client was employed as a courier. He had started his day with his daily duties, one of them being to remove parcels from a transport bin. As he attempted to remove an item from the transport bin, the said item came loose and rolled towards him, striking his hand.

As a result, our client suffered an open crush injury to his right dominant middle finger which caused a partial amputation of the distal fingertip. This further led to an altered sense of sensation, discomfort and a reduction in his grip.

Unfortunately, due to the nature of our client’s injuries, he was unable to return to work for six weeks and as a result of this experience he suffered an adjustment disorder with depression and anxiety.

Upon review of the medical evidence, gathered from Consultant Orthopaedic Surgeons, Consultant Plastic Surgeons, Consultant Hand Therapists and Consultant Psychiatrists, the Defendant’s Insurers made an offer of £25,000 general damages, which was deemed too low and subsequently rejected.

High Court Proceedings were issued on behalf of our client, however after lengthy negotiations with the Defendant’s Solicitors, an offer of £40,000 general damages was put forward and accepted.
