On the day of the accident our client sustained personal injury when attempting to walk up a set of steps located in a public car park. A loose paving slab flipped causing our client to fall and sustain serious injuries to their face and upper body, including a dislocated right shoulder. This resulted in a serious restriction in movement for our client and, as the injuries were largely to their dominant arm, caused a profound effect on their ability to carry out day-to-day tasks. It was established that there was a reasonable case that this unsecured slab was a serious tripping hazard.
These injuries had a significant impact on both our client’s physical and psychological wellbeing. Due to the injuries our client was unable to carry on with their usual physical lifestyle such as cycling and attending the gym, causing them to be impacted emotionally.
Independent medical evidence concluded that our client suffered serious pain and discomfort as a result of their injuries and needed physiotherapy.
Liability was initially denied by the Defendant, claiming that our client was at least partly responsible for their own misfortune.
High Court proceedings were issued as a result, but after lengthy negotiations, liability was accepted by the Defendant and our client received a settlement of £35,000.00.
