Our client, a lady in her fifties, has recovered £250,000 damages in a case relating to the treatment of her urinary incontinence.
In 2014, the Plaintiff was referred, on a private basis, for advice in association with her condition. She underwent treatment by way of hysterectomy, however, her symptoms became worse. Thereafter, she was referred to another Consultant and underwent a tension-free vaginal tape procedure in April 2015. That procedure involved the insertion of surgical mesh in an attempt to relieve her incontinence.
Instead of relieving her incontinence, after the procedure, the Plaintiff’s symptoms again deteriorated leading to her referral ultimately to a Consultant based in London for removal of the surgical mesh, an exercise undertaken in two stages in 2017 and 2018. Following the surgery, the Plaintiff continued to suffer ongoing symptoms.
The Plaintiff instructed Patrick Mullarkey of O’Reilly Stewart Solicitors to investigate her care and to seek compensation for the personal injuries, loss and damage sustained by her by reason of the alleged substandard care of the Treating Consultants. In addition to her ongoing complaints of incontinence, the Plaintiff suffered understandable upset and distress by reason of same. She also claimed damages in respect of financial loss that she had incurred, including the cost of private medical care and the cost of gratuitous care provided to her by her family and loved ones.
Prior to trial, settlement was agreed between the parties pursuant to negotiations between the representatives of the patient and the Doctors. In addition to payment of damages in the sum of £250,000 to the Plaintiff, the Defendants also agreed to discharge the full cost of the private medical care, the monies to be repaid to the Government in respect of benefits paid, and the Plaintiff’s legal costs associated with the prosecution of her action. The Defendants paid compensation to the Plaintiff without admission of liability.
