Dionne Darragh, of O’Reilly Stewart acted for Ms C, following a Road Traffic Accident in February 2021.
On the date of this accident, our client was the restrained driver of vehicle that was pulling away from a set of traffic lights, when the Defendant driver pulled alongside our client’s vehicle to enter her lane and ended up colliding with the side of her vehicle.
Our client was suffering with pre-existing mild coronary heart disease before the accident occurred. When considering the impact of an accident it is important to understand any relevant medical history. We investigated this further together with the client’s complaints of pain and discomfort to her right wrist, right clavicle, upper and lower back since the accident. Ms C was also diagnosed with an adjustment disorder together with phobic anxiety.
Dionne Darragh sought independent medical expert advice from consultants in emergency medicine and intensive care, psychiatry and cardiology to comment further on Ms C’s injuries. Expert evidence in this case not only supported the view that our client had suffered physical and psychology injuries as a direct result of the accident, but also supported the view that our client’s pre-existing coronary condition was temporarily worsened by the accident in the weeks following.
High Court proceedings were issued on behalf of Ms C. Following negotiations with the Defendant’s Solicitor, £25,000 for the injuries plus almost £2000 special damages in settlement was awarded to our client in advance of trial.
