The Employment Team at O’Reilly Stewart Solicitors acted on behalf our client at the Industrial Tribunal of Northern Ireland for multiple discrimination claims, leading to their unfair constructive dismissal by an independent public body.
Our client was subjected to discrimination due to their English background, gender, and their level of experience based upon their age. Our client had been performing well in an interim role and was subsequently denied the position on a fixed term basis. Multiple grievances were raised with dissatisfactory outcomes and intolerable treatment. In the absence of the Respondent following correct procedures, fundamental breaches of contract led to our client’s unfair constructive dismissal.
Following O’Reilly Stewart’s expert legal advice, including a complex calculation of the schedule of loss, our client received £100,000 in settlement with no admission of liability from the Respondent and agreement that no further legal claim may arise from this matter.
This case highlights an employer’s duty to protect staff from discriminatory treatment and the importance of implementing Policies and Procedures correctly. Any grievances raised and potential disciplinaries must be treated appropriately according to Company Policy.
