£600k Settlement in Catastrophic Road Traffic Accident

O’Reilly Stewart Solicitors were instructed on behalf of Mrs R following a road traffic collision in January 2019. Managing Director Stuart Gilmore acted in this case.

Mrs R was the driver of a vehicle on a main road County Down, when another driver entered our client’s lane, colliding head on with her vehicle. This collision sent our client’s vehicle off the road and into a nearby ditch.

Unfortunately, our client sustained several injuries including fractures of the ribs, costal margin, right pubic ramus and a transverse fracture of the L1-L4. She also sustained lacerations to her left eyebrow, elbow, abdomen and general bleeding around the liver and kidney. Our client further developed a hernia, which she received surgery for in November 2020.

As well as the physical injuries, Mrs R also suffered from Post Traumatic Stress Disorder (PTSD) following the collision. The injuries that our client sustained were life changing, significantly impacting her day-to-day activities. She heavily relied on the Community Occupational Therapy Team for assistance and has required special appliances to aide with sleeping, showering, and cooking.

On behalf of our client, O’Reilly Stewart obtained an extensive amount of independent medical evidence from specialist consultant orthopaedic surgeons, consultant psychiatrists, consultants in emergency medicine, consultant plastic and reconstructive surgeons, pain clinic consultants, and occupational therapists/care consultants. This evidence allowed O’Reilly Stewart to assess the level of physical and economic cost that our client endured as a result of this horrific incident. It further provided a foundation of information which highlighted not only the current, but also the future needs of our client.

Proceedings were issued on behalf of our client, and the case was listed for hearing in the High Court. However, after lengthy negotiations and consultations with the Defendant’s Solicitors, an offer of £600,000 for general damages was put forward and accepted, inclusive of the interim payments already made and in advance of the hearing to settle the case.
