O’Reilly Stewart Solicitors were instructed to investigate injuries sustained by our client Mr C, following an accident at work, in August 2021. Managing Director Stuart Gilmore acted in this case.
On the date of the incident, our client was employed by the Defendant as a Delivery Driver. Our client was undertaking training and and had a substantial weight dropped on his foot.
As a result, our client sustained a significant fractured first metatarsal shaft and was consequently placed in a walker boot. He further suffered ligamentous injuries to his first and second tarsometatarsal joints which brought severe pain and limited movement.
Unfortunately, due to the nature of our client’s injuries, his ability to work was confined to only operating machinery and he was unable to participate in sports such as rugby, running and cycling due to the pain.
Independent medical evidence was obtained from a Consultant Orthopaedic Foot, Ankle and Trauma Surgeon. Mr C’s injuries were examined in detail, giving comment to his injuries at the time of the consultation and a prognosis on any and all future symptoms that he would experience as a direct result of the incident.
Liability was accepted, although the Defendant raised the argument of contributory negligence.
Proceedings were then issued, and the case was listed in the High Court. Following lengthy negotiations, however, an offer of £75,000.00 was put forward and accepted to settle the case prior to the trial date.
