£275,000 Settlement in Accident at Work Case

O’Reilly Stewart Solicitors were instructed to investigate injuries sustained by our client, following an accident at work in December 2020. Stuart Gilmore acted in this case.
On the date of the accident, our client was employed by a manufacturing company and was seriously injured when his arm became trapped in a defective piece of industrial machinery.
Our client suffered numerous injuries, such as a fractured radius and ulna, as well as a transverse fracture of the middle third of his left humerus and underwent surgical fixation of his fractures. Unfortunately, our client has been left with a number of disfiguring scars and has further suffered PTSD from this harrowing experience.
The severity of this incident heavily impacted our client’s daily life, being unable to return to work and participate in sports such as football and running.
O’Reilly Stewart obtained an extensive amount of independent medical evidence from Consultants in Trauma and Orthopaedic Surgery, Plastic Surgery, and General Psychiatry. Further to this, an inspection of the Defendant’s premises by an Engineer was also arranged and an accountancy report was produced to help project the current and future losses our client would be subject to.
Proceedings were then issued against the Defendant employer, and the case was listed for hearing in the High Court. Following lengthy negotiations, however, a settlement of £275,000.00 was agreed in advance of the hearing. This case portrays the lengths and endeavours O’Reilly Stewart will go to to achieve the best result for our client, making sure to address not only current and historic losses, but also all and any future financial loss.
