Catherine Quigley, of O’ Reilly Stewart Solicitors, has negotiated a £100,000.00 settlement, from the Department for Infrastructure, for her client who was injured cycling to work.
Whilst cycling, our client hit a large pothole along the road which caused him to be thrown from his bicycle and sustain injuries to his knee. This pothole was an actionable defect along the road, that posed as a hazard to cyclists and motorists. When thrown from the bicycle, our client was left with a complex laceration and scarring to his knee which took a considerable amount of time to heal due to its severity. Moreover, he lost full flexion in his knee, and this caused a considerable impact on his once very active lifestyle. Understandably, he continued to struggle with anxiety towards cycling following the accident and was forced to take a step back from competitive cycling.
To assess the overall impact on our client, O’ Reilly Stewart instructed multiple medical experts, including a Consultant in Trauma and Orthopaedic Surgery, a Consultant Radiologist, a Consultant Plastic Surgeon and a Consultant Psychiatrist.
Proceedings were initiated in the High Court of Justice but, through negotiation, Catherine was able to settle this matter in the sum of £100,000.00. This settlement was obtained less than 2 years from the date of accident, showcasing her dedication to her client in achieving the best possible results in an expedient manner. The client has expressed that this has been an ‘incredible’ result.
