Dionne Darragh of O’Reilly Stewart Solicitors was instructed on behalf of a Client who was improperly diagnosed with Multiple Sclerosis (MS). Our Client suffered serious side effects and psychological distress due to the negligence of the Defendant in failing to accurately diagnose our Client. By virtue of the Defendants actions, our Client suffered ongoing side effects from the medication they were prescribed for the condition. These medications impaired our Client’s ability to work and carry on with their usual daily activities.
Our Client further suffered from anxiety, sleep disturbance along with severe headaches. These side effects were coupled with the immense psychological stress of having to cope with the incorrect diagnoses that had been made, causing severe loss of the pleasures and amenities in life.
Our Client continued to be treated for MS for ten years until it was confirmed in 2019 that our Client was not suffering from MS and this diagnosis had been incorrect.
O’Reilly Stewart obtained a number of Medical Experts in this case including a Consultant Neurologist, Forensic Pharmacologist and Consultant Psychiatrist.
Whilst liability was initially denied, upon obtaining independent medical evidence it was discovered that there was never sufficient evidence to diagnose our Client with Multiple Sclerosis and the course of treatment our Client was subjected to was not medically justified and inappropriate. In doing so the Defendant failed their duty to our Client
O’Reilly Stewart issued High Court Proceedings on behalf of the Client and following extensive negotiations in advance of the Hearing date, O’Reilly Stewart reached a settlement on behalf of our Client in the amount of £250,000.00 plus legal costs.
